Importing Seeds into Indonesia: duty is 0%, the permit is the gate

Key takeaway: HS 1209 "seeds, fruit and spores, of a kind used for sowing" reads almost identically across Indonesia's tariff schedule. The three codes checked here — onion seed 1209.91.10, flower seed 1209.30.00 and lucerne (alfalfa) seed 1209.21.00 — all show 0% import duty, 0% VAT, phytosanitary control 940 only, and no post-border or export control. The real dividing line is not in customs but in the Ministry of Agriculture permit track: horticultural seeds need the seed import permit under Permentan 14/2026, while food crops, plantations, forestry and livestock breeding each run their own regulation and their own directorate. Two things no seed escapes: the exporting country's phytosanitary certificate and inspection at the port of entry. INSW check, 3 Oct 2026.

Key questions on this page

What is the import duty on seeds in Indonesia?

On the three HS 1209 subheadings checked here (1209.91.10 / 1209.30.00 / 1209.21.00) MFN duty is 0% and VAT 0%; PPh 22 is 2.5% with an API licence and 7.5% without. Each subheading must still be verified per shipment on INSW — do not generalise "seeds = 0%" across other chapters.

What permits does importing seeds into Indonesia require?

Two layers. What customs sees at the border is control 940, phytosanitary. The real gate is the Ministry of Agriculture: horticultural seeds need the Izin Pemasukan Benih (seed import permit) issued by the Minister of Agriculture under Permentan 14/2026. Other crop groups do not travel this track.

Is every kind of seed governed by the same regulation?

No. Horticultural seeds follow Permentan 14/2026, while food crops, plantations, forestry and livestock breeding each have their own regulation and directorate. In the official agricultural licence list, "plant seed (benih tanaman)" and "livestock breeding stock (benih/bibit ternak)" are two separate permits.

What counts as "horticultural"?

Under Permentan 14/2026, horticulture covers fruit, vegetables, medicinal plant raw material and floriculture, including fungi, mosses and aquatic plants. Forage seed such as lucerne is not included — it is still subject to phytosanitary control but does not travel the horticultural seed permit track.

How long does the Indonesian seed import permit take?

Permentan 14/2026 sets the clock: completeness review within 2 working days, verification and validation up to 5 working days, and an application not refused within those periods is deemed approved. Export permits run 1 + 3 working days.

How long is the permit valid?

From Permentan 14/2026 it runs for one calendar year and expires on 31 December, regardless of the issue date (the old rule was six months). Applications for the following year may be filed from November of the current year.

Does 0% duty mean no barrier?

No. Duty is 0% on all three codes, yet every one of them carries phytosanitary control 940 and the Ministry of Agriculture permit still applies. The duty you save is nowhere near enough to cover demurrage or re-export caused by a missing permit.

Does FORM E make seeds duty free?

The ACFTA column shows 0% on all three, but INSW displays a historical year's value — it must be re-checked against the current concession schedule, code by code. Do not promise it on the strength of this page.

1. Start by placing your "seed" in the right heading

  • HS 1209 = seeds, fruit and spores, of a kind used for sowing. Vegetable, flower and forage seed all sit here — the three codes checked on this page belong to this heading.
  • Bulbs, corms and tubers for propagation are not in 1209 — they fall in Chapters 6 / 7 (garlic for propagation, for example, is 0703.20.10 "Bulbs for propagation" in Chapter 7). Both are "seed" in everyday speech, yet the chapter and the control regime differ.
  • Cereal seed sits in Chapter 10 (seed maize, paddy and so on) and follows a different HS path.
  • The test is use plus form, not the word "seed". Establish the use (sowing / food / processing), then the form (true seed / bulb or corm / cereal grain), and only then the code.
  • Get this wrong and everything downstream is wrong. It decides the duty, the quarantine category and — most importantly — which ministry issues your permit.
One-line rule
Do not ask first "what is the duty on seed". Ask "does Indonesia classify this shipment as seed for sowing". Answer that correctly and duty is usually cheap (0% on all three codes here); the real cost and risk sit on the permit track.

Spotlight: garlic seed 0703.20.10 — not in 1209, but on the same ministry track

  • First rule: garlic seed is not classified in 1209. Bulbs, corms and tubers for propagation are not "seeds, fruit and spores of a kind used for sowing" — they sit in Chapter 7. Garlic seed is 0703.20.10 Bulbs for propagation.
  • But the permit track is the same one. Both the three 1209 codes on this page and garlic seed carry only control 940 (plant quarantine) at the customs tariff level. The real gate sits with the Ministry of Agriculture (Kementan).
  • The tax burden is light: BM 0%, PPN 0% (verified reading, still subject to the rules in force), PPh 22 2.5% with API / 7.5% without — identical to the three 1209 codes.
  • Get the unit right: the Indonesian legal unit is the metric ton (1000 kg, code TNE), not kilograms.
  • The most expensive mistake is declaring seed garlic as table garlic. Land on 0703.20.90 and BM moves from 0% to 5%, while control 958 (LS) and 959 (PI) attach — you overpay duty and run short of permits at the same time.

What the garlic seed track requires
Garlic falls under the horticulture (hortikultura) group and follows Permentan 14/2026 (in force 2026-07-31, replacing Permentan 15/2017 and 26/2018). Applications normally attach four sets of documents from the country of export: (1) seed quality and class documents; (2) the exporting country’s seed certificate; (3) a variety description; and (4) a crop development plan — with the requested import volume matching that plan. Also confirm the specific plant-quarantine treatment for fresh Allium bulbs (Permentan 43/2012) and whether your port of entry is an authorised one.

  • Duty and VAT readings are identical across the three codes — at tariff level, vegetable, flower and forage seed look exactly the same.
  • PPh 22 triples without an API licence (2.5% vs 7.5%), so decide the importing entity's standing early.
  • VAT reads 0% under the agricultural treatment; re-check against the rules in force and do not promise it on this basis.
  • None of the three carries anti-dumping or safeguard duty — that is this reading, not a permanent guarantee.

3. Lartas controls: customs only sees 940

  • At the border (needed to clear): 940 phytosanitary — under Law 21/2019 (the INSW page still labels it with the older PP 14 Tahun 2002), evidenced by documents of the KT-2 / KT-9 / SP-5 / KT-13 family. All three codes carry it.
  • Post-border: no such block appears on any of the three pages — no circulation-stage control is attached to these codes.
  • Export control (Lartas Ekspor): no such block on any of the three pages.
  • The key inference: in INSW's tariff and Lartas layer you cannot see any split between horticulture, food crops and forestry — samples from all three read identically. The split is not in customs; it is on the Ministry of Agriculture permit side.

4. The real split sits with the Ministry of Agriculture: five layers

Layer 1 · Regulation follows the crop group. Horticultural seed follows Permentan 14/2026; food crops, plantations, forestry, livestock breeding and fisheries each have their own regulation and directorate. Applying the horticultural rule to food-crop seed is wrong at step one.

Layer 2 · The licence list is split by design. In the Ministry's licence framework (the licensing system of Permentan 45/2019, which replaced Permentan 40/2019), plant seed sits under entry/exit licences alongside genetic resources, feed material and veterinary drugs, while livestock breeds sit under recommendation licences — two different procedures and two different permits.

Layer 3 · Purpose decides the track. Permentan 14/2026 sets administrative and technical requirements per import purpose: variety registration for circulation, commercial procurement of quality seed, import of parental lines for multiplication, seed development for export markets, production of horticultural produce, laboratory testing, variety protection testing, hobbyist use, exhibitions and promotion, ISTA certification testing, and seed procurement for the garlic self-sufficiency programme. Different purpose, different file.

Layer 4 · Genetically engineered material takes an extra gate. Seed derived from genetic engineering must satisfy biosafety requirements and obtain a recommendation from the biosafety commission for genetically engineered products before the permit process can proceed.

Layer 5 · Two legs nobody escapes. Whatever the crop group: the exporting country's phytosanitary certificate plus inspection at the port of entry, and INSW automatically attaching Lartas at eight-digit level. These are not horticulture-specific; they are the common threshold for every seed.

5. Permentan 14/2026 in practice (horticultural seed)

  • Who may apply: narrowed to business entities, government agencies and individuals — the former "plant observer" category is no longer a separate applicant type and is handled as a purpose instead.
  • A leaner administrative file: focused on competence documents — NIB, the seed producer/distributor competency certificate and quarantine documents. The old bundle (deed of establishment, NPWP, company profile, ID card, domicile letter, API, seed producer registration) is gone.
  • Fully online and wired into INSW: filed through the agricultural licensing system, and issued permits are forwarded automatically to the Indonesia National Single Window (SINSW).
  • Timelines are written down: import permit — completeness review in 2 working days, verification and validation up to 5 working days, and deemed approved if not refused in time. Export permit — 1 + 3 working days.
  • Valid one calendar year: expiring on 31 December regardless of issue date (previously six months); applications for the next year open from November.
  • First-time imports can be escalated: a first import of a given species from a given origin country may require a pest risk analysis (PRA).
  • Repackaging and relabelling: imported seed that has undergone quality testing (particularly in non-commercial packaging) must be repackaged and relabelled with the test results.
  • Sanctions are tiered: written warning, then revocation if unheeded within 7 working days; specific breaches can bar new permits for 1–2 years and/or pull the product from circulation.

6. Upstream change: PP 7/2026 repealed PP 44/1995

  • PP 7/2026 took effect on 9 February 2026 (State Gazette No. 17 of 2026) as the implementing regulation of Law 22/2019 on sustainable agricultural cultivation systems.
  • It repealed six old government regulations in one go, including PP 44/1995 on plant seeding. The other five covered pesticides, plant protection, fertilisers, agricultural machinery and cultivation businesses.
  • Seed and inputs under mandatory standards: distributed high-quality seed, fertilisers, pesticides and machinery must meet SNI or minimum technical requirements, certified through accredited testing laboratories.
  • Genetic resources must be registered and banked: searching, collecting and using plant genetic resources requires a ministerial licence; results must be reported and part of the material deposited in the national gene bank.
  • Stronger sanctions: tiered administrative penalties including product withdrawal, an administrative fine of Rp50,000,000 and revocation of the business licence.
  • Transitional caution: implementing detail is still landing — treat the prevailing announcement of the competent authority as decisive, not this page.
